These Terms & Conditions (the “Terms”) form a binding agreement between you and DukeDeals (“DukeDeals,” “we,” “us,” or “our”) governing your use of dukedeals.shop (the “Site”) and your purchase of office desks, office chairs, bookshelves and other products from us. Please read them carefully. By accessing the Site, creating an account or placing an order, you agree to these Terms and to the policies they reference, including our Privacy Policy, Shipping Policy and Refund & Returns Policy.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract to place an order. If you order on behalf of a business, you confirm that you are authorized to bind that business to these Terms.
2. Your account
You may check out as a guest or create an account. If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Tell us promptly at support@dukedeals.shop if you suspect unauthorized use. We may suspend or close accounts that breach these Terms or are used fraudulently.
3. Product information
We work hard to describe our furniture accurately, including dimensions, materials, finishes, weight capacities and assembly requirements. However:
- Colors and finishes may look slightly different in person than on screen because of monitor settings and lighting. Wood products can show natural variation in grain and tone.
- Measurements are approximate and may vary slightly from listed figures due to manufacturing tolerances. Please measure your room, doorways and stairways before ordering larger items.
- Images may show décor, accessories or equipment (such as monitors, books or lamps) that are not included. Only the items listed in the product description are included in your order.
If a product you receive does not match its description, your remedy is described in our Refund & Returns Policy.
4. Prices and availability
All prices are shown in US dollars. Prices, promotions and product availability can change at any time without notice, but changes will not affect orders we have already accepted. Applicable sales tax is calculated at checkout based on your delivery address. If a product is listed at an incorrect price or with incorrect information because of an error, we reserve the right to cancel orders for that product, even after an order confirmation has been sent. If your payment has already been taken, we will refund it in full.
5. Orders and acceptance
When you place an order, you make an offer to buy the products in your cart. You will receive an automatic email acknowledging your order; this acknowledgment is not acceptance. A contract is formed when we dispatch the products and send you a shipping confirmation. We may decline or limit any order, for example where stock is unavailable, where we cannot verify payment, where we suspect fraud, or where an order appears to be placed by a reseller. If we cancel an order after payment, we refund you in full.
6. Payment
Payment is due in full at checkout using one of the payment methods displayed on the checkout page. By submitting payment details, you confirm that you are authorized to use the payment method and authorize us and our payment processors to charge the total order amount, including applicable taxes. If a payment is declined or reversed, we may cancel or suspend the order.
7. Business quotes
Written quotes for multiple items are valid for the period stated on the quote, or 14 days if no period is stated. Quotes are subject to stock availability at the time you place the order and to these Terms.
8. Order changes and cancellations
You may change or cancel an order free of charge until it has been dispatched. Contact us as soon as possible at support@dukedeals.shop or (585) 470-6042 with your order number. Once an order has left our warehouse, it can no longer be cancelled, but you may return it under our Refund & Returns Policy.
9. Shipping, title and risk
Delivery terms are set out in our Shipping Policy. Title to the products and risk of loss pass to you when the products are delivered to the address you provided. Delivery timeframes are estimates and not guaranteed.
10. Returns, refunds and warranty
Returns and refunds are governed by our Refund & Returns Policy, which forms part of these Terms. Products are covered by our 1-year limited warranty against manufacturing defects, as described in that policy.
11. Assembly and safe use
Most products require assembly. You are responsible for assembling products according to the included instructions, using them for their intended purpose, and staying within stated weight limits. Tall furniture such as bookshelves and bookcases can tip over; always secure them to the wall with an anti-tip anchor suitable for your wall type, and never allow children to climb on furniture. Adjustable chairs and height-adjustable desks should be operated as described in their instructions. DukeDeals is not responsible for damage or injury caused by improper assembly, modification, misuse or overloading.
12. Intellectual property
All content on the Site, including text, graphics, logos, product descriptions, page designs and software, is owned by or licensed to DukeDeals and is protected by copyright, trademark and other laws. You may view and print pages for personal, non-commercial use only. You may not copy, reproduce, scrape or republish Site content for commercial purposes without our written permission.
13. Acceptable use
When using the Site, you agree not to: break any law; submit false or misleading information; use another person’s payment method without authorization; interfere with the Site’s security or operation; introduce malware; use automated tools to scrape data or place orders; or post content that is unlawful, abusive or infringes others’ rights.
14. Reviews and submissions
If you submit a product review, comment or other content, you confirm that it is honest, reflects your own experience, and does not infringe anyone’s rights. You grant DukeDeals a non-exclusive, royalty-free license to display that content on the Site. We may remove content that breaches these Terms.
15. Disclaimer of warranties
Except for the express limited warranty in our Refund & Returns Policy, and to the fullest extent permitted by law, the Site and products are provided “as is” and “as available,” and DukeDeals disclaims all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.
16. Limitation of liability
To the fullest extent permitted by law, DukeDeals and its owners, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunity, arising from your use of the Site or products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnity
You agree to indemnify and hold harmless DukeDeals from claims, losses and expenses, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Site or products.
18. Governing law and disputes
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Before starting any formal proceeding, please contact us so we can try to resolve the issue informally; most concerns are settled quickly this way. If a dispute cannot be resolved informally within 30 days, it will be brought exclusively in the state or federal courts located in Monroe County, New York, and you and DukeDeals consent to the jurisdiction of those courts. Nothing in this section prevents either party from bringing an eligible claim in small claims court.
19. Events beyond our control
We are not liable for delays or failures caused by events outside our reasonable control, including severe weather, natural disasters, carrier disruptions, labor disputes, supply shortages, power or internet outages, or government action.
20. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent. These Terms, together with the policies referenced above, are the entire agreement between you and DukeDeals regarding the Site and your purchases.
21. Changes to these Terms
We may update these Terms from time to time. The version posted on the Site when you place an order applies to that order. The “Last updated” date shows when the Terms were last revised.
